BELOIT AUCTION – TERMS & CONDITIONS
Welcome to Beloit Auction! All items in this auction are located at 1525 Sun Valley Drive, Beloit, WI. The following terms and conditions apply to all bidders and purchases. By registering and bidding, you agree to these Terms & Conditions, which form part of the Offer to Purchase.
(1.) Bidder Registration
YOU must register to bid.
Auctioneer may establish registration requirements and qualification criteria, as determined in Auctioneer’s discretion.
You must provide identifying and financial information as requested.
Auctioneer may refuse registration, revoke bidding privileges, or allow unregistered bidders to participate.
Bidder qualification and registration provisions are intended for the benefit of the Auctioneer and Seller only.
By bidding, all bidders agree to these Terms & Conditions.
Each bidder is assigned a unique bidder number.
All bids are irrevocable and binding.

(3.) Auctioneer’s Discretion
Auctioneer reserves the right to reject any bid, regulate bidding increments, resolve bidding disputes, and re-offer any lot at its discretion.
Auctioneer’s record of bids and communications shall be final and conclusive in all disputes.
Auctioneer’s decision shall be final.
(4.) Property Condition
All property is sold “AS IS,” “WHERE IS,” and “WITH ALL FAULTS.”
Neither Auctioneer nor Seller makes any representation or warranty—express or implied—regarding authenticity, condition, merchantability, fitness for purpose, or non-infringement.
Photographs and descriptions are for convenience only. Inspect in person or rely on images provided.
All sales are final with no refunds or returns.
(5.) Payment Terms
Buyer’s Fee: 16% added to the final bid price plus applicable sales tax.
Card Payments: Additional 3.5% convenience fee applies.
Accepted Forms of Payment: Cash, wire transfer, Visa, MasterCard, Discover, American Express, debit.
No Checks Accepted.
Cash/Wire Requirement:
Payment must be completed online through your emailed invoice link or in person at 534 West Grand Avenue, Beloit, WI.
Buyer’s Premium is non-refundable and earned by Auctioneer as compensation.
(6.) Pickup & Removal
Pickup Location: 1525 Sun Valley Drive, Beloit, WI.
Pickup Hours:
Monday, November 3, 2025: 10:00 AM – 4:00 PM
Tuesday, November 4, 2025: 10:00 AM – 4:00 PM
Saturday, November 8, 2025: 9:00 AM – 11:00 AM (if you choose to pick up on Saturday, an additional $50 will be added per lot).
All items must be picked up by Saturday at 11:00 AM.
A $100 per-lot handling/restocking charge applies to unpaid or unclaimed items, automatically charged to your card on file.
Items not removed by Saturday at 11:00 AM are deemed abandoned. Ownership rights are forfeited, and items may be disposed of or resold.
Failed card payments result in account suspension and a minimum $50 service charge.
Bring your own help, vehicles, boxes, and packing materials. Beloit Auction staff will have a forklift onsite to help with moving/loading pallets of flooring.
(7.) No Chargebacks
Buyer agrees not to initiate credit card chargebacks or payment disputes.
Buyer remains liable for full payment plus attorney’s fees, collection costs, and any imposed fees.
(8.) Default & Remedies
If Buyer fails to pay or pick up, Auctioneer may resell, pursue collection, or take legal action.
Buyer responsible for deficiencies, storage, resale fees, 1.5% monthly interest, attorney’s fees, and collection costs.
(9.) Communications
By registering, you consent to contact via email, text, or phone regarding invoices, pickup, or other auction-related matters.
You also agree to receive marketing and auction updates (unsubscribe anytime via email link).
Transactional emails cannot be unsubscribed from.
(10.) Theft, Tampering & Conduct
Anyone caught tampering with tags, merchandise, or shoplifting will be prosecuted.
Abusive or threatening behavior toward staff will not be tolerated and may result in permanent ban.
(11.) Descriptions & Inspection
Beloit Auction will not be held responsible for description inconsistencies.
Buyers must inspect and decide for themselves prior to bidding.
No reliance on verbal statements.
(12.) Legal Contract (UCC §2-328)
At the close of each lot, a legally binding contract is created.
Buyers are responsible for safeguarding purchases at pickup.
(13.) Buyer Responsibility
Buyers must provide their own packing, boxes, vehicles, and loading help.
Beloit Auction is not responsible for injury or damage during loading or removal.
(14.) Auctioneer Bidding
(15.) Sales Tax & Exemptions
Valid exemption certificates must be submitted before bidding.
No retroactive refunds.
Sales tax collected per applicable jurisdiction.
Buyers must report and pay any required use tax in their home state.
(16.) Right to Withdraw Lots
(17.) Indemnification
Bidders agree to indemnify and hold harmless Beloit Auction & Realty, Inc., its owners, staff, and sellers against all claims or damages from participation or use of purchased items.
(18.) Force Majeure
Beloit Auction is not liable for delays caused by events beyond its control (natural disasters, internet failures, strikes, fire, etc.).

(20.) Premises Liability Waiver
All persons enter auction premises or pickup sites at their own risk.
Beloit Auction is not responsible for accidents, injuries, or property damage.
(21.) Media & Marketing Use
By participating, Buyer consents to the use of photos, video, or audio taken during preview, bidding, or pickup for Beloit Auction’s promotional purposes.
(22.) Staggered Closing
Online auctions use staggered closing—multiple lots close each minute in sequence.
For grouped or related lots, bidding on one may extend the time on others in that group.
(23.) Soft Close
If a bid is placed within 90 seconds of closing, that lot’s close time extends 90 seconds.
The extension continues until no further bids are received.
(24.) Technology Disclaimer
Auctioneer is not responsible for interruptions, errors, or software malfunctions.
Auctioneer may void or resell affected lots.
Decision of the Auctioneer is final.

(26.) Governing Law & Venue
These Terms are governed by the laws of the State of Wisconsin.
Venue for disputes: Rock County, Wisconsin.
Auctioneer entitled to recover time, costs, and attorney’s fees as damages.
(27.) Limitation of Liability
Auctioneer’s liability to any bidder is limited to a refund of amounts actually paid for the disputed item, not exceeding purchase price.
Auctioneer is not liable for incidental, consequential, or special damages.
