Welcome to the Legends of the Road Auction! Unless otherwise noted in the lot description, all vehicles in this auction are located at Beloit Auction, 534 W. Grand Avenue, Beloit, Wisconsin 53511. These Terms and Conditions govern your participation in this auction.


(1) Bidder Registration



  • YOU must register to bid. Auctioneer may establish registration requirements and bidder qualification criteria, at its sole discretion.

  • You agree to provide any requested identifying and financial information. Auctioneer reserves the right to deny or revoke bidding privileges to any individual or entity, including those who have not completed all registration requirements.

  • Any person placing bids without completing registration nonetheless agrees to be bound by these Terms and Conditions.

  • Registration provisions are for the benefit of Auctioneer and Seller only and create no enforceable rights in others. Auctioneer or Seller may waive or enforce registration criteria globally or case by case.

  • By registering, you agree to these Terms and Conditions as a condition of bidding. All bids you submit are irrevocable and binding offers to purchase.


(2) Account Responsibility



  • You are responsible for maintaining the confidentiality of your username and password.

  • You accept full liability for any and all activity conducted under your account.


(3) Auctioneer’s Discretion



  • Auctioneer reserves the right to reject any bid, regulate bidding increments, resolve disputes, and re-offer any lot at its discretion.

  • Auctioneer’s record of bids, transactions, and communications shall be deemed final and conclusive in all disputes.

  • Auctioneer’s decision is final in all cases.


(4) AS-IS, WHERE-IS, WITH ALL FAULTS



  • All property is offered strictly "AS IS," "WHERE IS," and "WITH ALL FAULTS," including any hidden defects, without any express or implied warranties.

  • No statement—oral, written, or pictorial—by Auctioneer, staff, or Seller will create any warranty, representation, or guarantee.

  • All warranties, including merchantability, non-infringement, authenticity, and fitness for a particular purpose, are expressly disclaimed.

  • You acknowledge that you have had the opportunity to inspect each lot personally or rely solely on your judgment and any photographs provided.

  • All sales are final, with no refunds or returns.


(5) Buyer’s Fee and Payment



  • A 16% buyer’s fee will be added to the final bid price, plus applicable sales tax.

  • The Buyer’s Premium is earned by the Auctioneer as compensation and is non-refundable under any circumstances.

  • All vehicle purchases must be paid in full by cash or wire transfer. Credit/debit cards are not accepted for vehicle payments.

  • No checks will be accepted.


(6) Title & Registration



  • Titles will only be released once full payment has cleared by cash or wire transfer.

  • Vehicles may not be removed until payment is complete.

  • Buyer is responsible for title transfer, registration, and all applicable taxes/fees.


(7) Default & Remedies



  • If Buyer fails to pay in full or fails to pick up purchases, Auctioneer may, at its discretion, resell the property, pursue collection, or take legal action.

  • Buyer will be responsible for all deficiencies, storage, handling, resale fees, attorney’s fees, and costs of collection.


(8) Communications



  • By registering, you agree Beloit Auction may contact you by email, phone, or text regarding invoices, payments, pickup, or account status.

  • By registering, you also consent to be added to Beloit Auction’s email list for future auction notices and promotional updates. You may unsubscribe from marketing emails at any time.

  • Transactional communications related to your purchases (invoices, reminders, etc.) are essential and cannot be unsubscribed from.


(9) Theft & Tampering



  • Any person caught tampering with merchandise, altering tags, or committing theft will be prosecuted to the fullest extent permitted by law and permanently banned from auctions and facilities.


(10) Descriptions & Inspection



  • Descriptions, announcements, and images are provided for convenience only and are not guaranteed.

  • You alone are responsible for inspecting items and determining suitability before bidding.


(11) Binding Contract



  • Under UCC §2-328, each final bid constitutes a legally binding contract.

  • Buyer is responsible for safeguarding purchases once paid for.


(12) Packing & Loading



  • Buyers must bring their own vehicles, trailers, labor, boxes, tools, and equipment to load, secure, and protect purchases.


(13) Auctioneer Participation



  • Auctioneer and staff may bid on and purchase items in any auction.


(14) Sales Tax & Exemptions



  • Valid exemption certificate must be submitted before bidding. No retroactive refunds.

  • Sales tax will be collected as required by law based on jurisdiction where the sale occurs. Buyers are responsible for reporting and paying any use tax owed in their state.


(15) Right to Withdraw Lots



  • Auctioneer/Seller may add, delete, or withdraw lots at any time before or during the auction.


(16) Indemnification



  • Buyer agrees to indemnify and hold harmless Beloit Auction, its owners, staff, and Seller from claims, damages, or expenses arising from participation or use/misuse of purchased property.


(17) Force Majeure



  • Auctioneer is not liable for delays caused by events beyond control (natural disasters, internet failures, strikes, fire, government action, etc.).


(18) Age Requirement



  • You must be 18 or older to register and bid.


(19) Premises Liability Waiver



  • All persons entering Beloit Auction’s premises or pickup locations do so at their own risk.

  • Auctioneer is not liable for accidents, injuries, or damage to persons or property.


(20) Media & Marketing Use



  • By participating, Buyer consents to use of photos, video, or audio taken at preview, bidding, or pickup for Auctioneer’s promotional purposes.


(21) Staggered Closing



  • Online auctions use staggered closing. Lots will close at the rate of 1 lot every 2 minutes.


(22) Soft Close



  • If a bid is placed in the last 90 seconds of a lot, bidding extends another 90 seconds.

  • This repeats until no further bids are placed.


(23) Technology Disclaimer



  • Auctioneer is not responsible for interruptions, errors, or system failures.

  • Auctioneer may void or resell lots affected by malfunctions.

  • Auctioneer’s decision is final.


(24) Severability



  • If any provision is found invalid, the remaining provisions remain in full force.


(25) Limitation of Liability



  • Auctioneer’s liability to any Buyer shall not exceed the purchase price of the item in dispute.

  • Auctioneer shall not be liable for incidental, special, or consequential damages.


(26) Governing Law & Venue



  • These Terms are governed by Wisconsin law.

  • Venue for all disputes is exclusively Rock County, Wisconsin.

  • Buyer agrees Auctioneer is entitled to recover time, costs, and attorney’s fees in any legal action.
