Listing Terms and Conditions

Welcome to Beloit Auction! All items in this auction are located at Beloit Auction, 534 W. Grand Avenue, Beloit, Wisconsin. These Terms and Conditions govern your participation in this auction.

(1) Bidder Registration

You must register to bid. Auctioneer may set registration requirements and bidder qualification criteria at its sole discretion. You agree to provide any requested identifying and financial information. Auctioneer reserves the right to deny or revoke bidding privileges to any individual or entity, including those who have not completed all registration requirements. Any person placing bids without completing registration nonetheless agrees to be bound by these Terms and Conditions. All registration provisions are for the benefit of Auctioneer and Seller only and create no enforceable rights in others. Auctioneer or Seller may waive or enforce registration criteria, globally or on a case-by-case basis. By registering, you agree to these Terms and Conditions as a condition of bidding. All bids you submit are irrevocable and binding offers to purchase.

(2) Account Responsibility

You are responsible for maintaining the confidentiality of your username and password. You accept full liability for any and all activity conducted under your account.

(3) AS-IS, WHERE-IS, WITH ALL FAULTS

All property is offered strictly “AS IS,” “WHERE IS,” and “WITH ALL FAULTS,” including any hidden defects, without any express or implied warranties. No statement—oral, written, or pictorial—by Auctioneer, staff, or Seller will create any warranty, representation, or guarantee. All warranties, including those of merchantability, non-infringement, authenticity, and fitness for a particular purpose, are expressly disclaimed. You acknowledge that you have had the opportunity to inspect each lot personally or rely solely on your judgment and any photographs provided. You accept that all sales are final, with no refunds or returns.

(4) Buyer’s Fee and Payment

A 16% buyer’s fee will be added to the final bid price, plus applicable sales tax. Credit or debit card payments incur an additional 3.5% convenience fee.

  • Invoices totaling $300 or more in coins, jewelry, vehicles, powersports, trailers, gold, silver, currency, or other “sensitive” items, must be paid by cash or wire transfer.

  • Auctioneer reserves the right to require cash or wire transfer payment on any invoice, regardless of amount, to prevent fraud.

  • All wire transfer fees are the responsibility of the buyer.

  • Other purchases may be paid by cash, Visa, MasterCard, American Express, Discover, or debit card.

  • No checks will be accepted.

Payment must be completed either online via the link in your invoice or in person during your scheduled pickup.

(5) Pickup and Forfeiture

This auction starts to close at 7:07 p.m. on Monday, October 20, 2025. Pickup is the same week, Wednesday from 10:00 a.m. to 4:00 p.m., Thursday from 10:00 a.m. to 6:00 p.m., Friday from 10:00 a.m. to 4:00 p.m., and Saturday from 9:00 a.m. to 11:00 a.m. Winning bidders will be sent a message from Shipping Saint (our online scheduling program) to choose their pickup date and time.

All items must be paid for and picked up by 11:00 a.m. Saturday following the auction.

Items not picked up by this deadline will incur a $30 handling/restocking charge plus tax, and your credit card on file will be charged for the invoice total plus this fee.

  • Items not picked up by 3:00 p.m. the following Tuesday, October 28, 2025, will be deemed abandoned and may be resold at Auctioneer’s discretion.

  • No refunds or credits will be issued for abandoned items.

  • If your card on file cannot be charged, your account will be suspended until your invoice is settled or a $75 service fee is paid, whichever is greater. You may also be permanently blocked from bidding or face legal action.

(6) Shipping

Shipping may be available on select items at the buyer’s expense. All shipping, handling, and insurance charges will be invoiced separately.

  • Requests for shipping must be made promptly after the auction ends through the email/message from Shipping Saint.

  • If you request shipping and later cancel after packing has begun, a minimum $30 fee will apply for labor and materials.

  • Auctioneer is not responsible for loss or damage once items are released to the carrier. Insurance will be added to all shipping requests. All risk of loss passes to the buyer upon shipment.

(7) Communication Consent

You agree that Beloit Auction may contact you by email, phone, or text regarding invoices, payments, pickup arrangements, account status, or any other matters arising from your participation in the auction. By registering to bid, you also consent to be added to our email distribution list to receive notices of future auctions, promotions, and related updates. You may unsubscribe from marketing and promotional emails at any time by following the instructions provided in those messages. Transactional communications (invoices, reminders, and participation notices) are considered essential and not subject to opt-out.

(8) Theft and Tampering

Any person caught tampering with merchandise, altering tags, or committing theft will be prosecuted to the fullest extent permitted by law. In addition, such individuals will be permanently banned from participating in any future auctions and prohibited from entering our facilities.

(9) Descriptions and Inspection

Descriptions, announcements, and images are provided for convenience and are not guaranteed. You alone are responsible for inspecting items and determining suitability before bidding. Dimensions, weights, counts, and conditions are approximate.

(10) Binding Contract

Under UCC 2-328, each final bid constitutes a legally binding contract. You are responsible for safeguarding your purchases once paid for and are encouraged to retrieve items promptly.

(11) Packing and Loading

Buyers must bring their own vehicles, labor, boxes, tools, and equipment to load, secure, and protect their purchases. Buyers requesting loading assistance (including forklift use) do so at their own risk, and Auctioneer assumes no liability for damage or injury.

(12) Auctioneer Participation

Auctioneer and staff may bid on and purchase items in any auction.

(13) Staggered Closing

Auction lots will close on a staggered schedule. Each item has a scheduled closing time. Lots will close at the rate of 3 lots every 2 minutes (unless there is extended bidding). That’s 1 lot every 40 seconds.

(14) Soft Close

If a bid is placed within the final 90 seconds of a lot’s scheduled closing time, bidding on that lot will be extended by an additional 90 seconds. This process repeats until no further bids are placed in the last 90 seconds. Feel free to use the maximum bidding feature if you are worried about missing the chance to bid on an item.

(15) Technology Disclaimer

Auctioneer is not liable for service interruptions, errors, or system failures and does not guarantee uninterrupted access to the auction platform. Auctioneer may void any sale or temporarily suspend bidding due to technological issues, at its sole discretion. Auctioneer’s decision in such matters is final.

(16) Jurisdiction and Legal Fees

Any disputes shall be resolved exclusively in Rock County, Wisconsin. Beloit Auction will be entitled to recover all legal costs, time, and attorney fees incurred in enforcing these Terms and Conditions.
