Best Estate Services, Inc. | No Reserve ALL PROPERTY IS SOLD AS IS, WHERE IS, WITH ALL FAULTS. This is not an approval sale. All sales are final. No returns, refunds, credits, or exchanges will be permitted under any circumstances. 1. Conditions of Sale This is a public auction conducted by Best Estate Services, Inc. (“Auctioneer”), which acts solely as agent for the consignor or seller unless otherwise expressly stated. By registering to bid and/or placing a bid, each bidder agrees to be bound by these Terms & Conditions, together with any additional terms, notices, auction information, invoices, shipping terms, or announcements published by the Auctioneer or the bidding platform for the sale. A successful bid constitutes a legally binding agreement to purchase, and the successful bidder assumes full responsibility for payment and removal of the property in accordance with these Terms & Conditions. 2. Catalog Descriptions; Condition; As-Is Sale All lots are sold AS IS, WHERE IS, WITH ALL FAULTS, and without any representation or warranty, express or implied, including but not limited to any warranty as to authenticity, attribution, authorship, age, origin, condition, size, quality, rarity, provenance, importance, historical relevance, or fitness for a particular purpose. Best Estate Services, Inc. endeavors in good faith to identify, catalog, photograph, and describe each lot as accurately as reasonably possible based on the information available at the time of cataloging. Catalog descriptions, photographs, dimensions, and condition comments are provided solely as a courtesy for identification and general guidance. They are statements of opinion only and shall not be relied upon as statements of fact, guarantees, or warranties. No oral statement or written statement made by the Auctioneer, its employees, or representatives shall be deemed a warranty or guarantee unless expressly stated in writing by the Auctioneer. 3. Inspection and Bidder Responsibility Prospective bidders are strongly encouraged to inspect property prior to bidding. If in-person inspection is not possible, bidders are responsible for requesting additional information, condition comments, or photographs before placing a bid. Because many lots are antique, vintage, used, or estate property, they may exhibit age, wear, repairs, restorations, alterations, losses, imperfections, or other condition issues not specifically noted in the catalog description or photographs. The absence of a condition statement does not imply that a lot is free from defects. By bidding, each bidder acknowledges that they have had the opportunity to inspect the property and are relying solely on their own judgment in determining the condition, value, and suitability of the lot. 4. Online Bidding; Technical Issues; Closing of Lots This is an online auction. Bidding depends on third-party technology, internet connectivity, software, servers, devices, and the bidding platform. Best Estate Services, Inc. shall not be responsible for missed bids, delayed bids, failed transmissions, platform interruptions, browser issues, internet outages, or other technical failures beyond its reasonable control. Because of internet latency or device-related delay, bids placed at the last moment may not be received or recorded in time. Bidders are encouraged to refresh their browser near the close of bidding and to use the Max Bid feature whenever possible. Final auction results shall be based on the records maintained by the bidding platform and the Auctioneer. In the event of a dispute, clerical error, or technical malfunction, the Auctioneer shall have sole discretion to determine the successful bidder, reopen bidding, withdraw a lot, cancel a sale, or otherwise resolve the matter. 5. Buyer’s Premium and Additional Charges The total purchase price for each lot shall consist of the hammer price plus the applicable buyer’s premium and any other applicable charges. Buyer’s Premium $0 to $2,500: 20% $2,501 to $5,000: 18% $5,001 and above: 15% A 3% credit/debit card processing fee will be added to all payments made by card. The total amount due may also include applicable taxes, shipping charges, packing charges, handling charges, storage charges, insurance charges, and any other charges specifically disclosed in the auction listing or invoice. 6. Payment Terms All purchases must be paid in U.S. Dollars (USD). Accepted Forms of Payment Visa MasterCard Discover Cashier’s Check Wire Transfer American Express is not accepted. Cash is not accepted at any local pick-up location. For purchases under $1,500, payment may be made by credit/debit card, cashier’s check, or wire transfer. Unless other arrangements are approved in advance, the credit card on file may be automatically charged following the close of the auction for eligible invoices. For purchases over $1,500, payment must be made by cashier’s check or wire transfer only. The Auctioneer reserves the right to require a bank letter of reference or other satisfactory proof of funds before releasing property. Checks should be made payable to: Best Estate Services, Inc. To arrange a wire transfer, please call: (262) 799-5167 Shipping, packing, handling, insurance, and related charges are invoiced separately through Shipping Saint. Property will not be released for shipment or pick-up until all amounts due have been paid in cleared funds. 7. Shipping and Local Pick-Up Buyers are solely responsible for all shipping, packing, handling, freight, insurance, and delivery costs. Shipping is not included in the hammer price or purchase price unless expressly stated. Shipping coordination and shipping invoicing are facilitated through Shipping Saint, our third-party shipping platform. A separate shipping invoice is generally issued within five (5) business days following the close of the auction. Shipping charges will include applicable carrier charges together with packing and handling fees based on the size, shape, fragility, and shipping requirements of the contents. Such charges may vary by lot and by shipment. Packages will be released only after full payment of the lot invoice and any shipping invoice has been received and cleared. Tracking information will be provided when available. Best Estate Services, Inc. does not guarantee shipping rates, delivery times, or carrier performance and shall not be liable for loss, delay, or damage once property has been released to Shipping Saint, a carrier, freight provider, or other third-party shipper. Oversized, fragile, high-value, or specialty items may require custom packing or third-party freight service. Bidders are encouraged to contact us before bidding to confirm shipping availability and estimated shipping requirements. Local Pick-Up Local pick-up is available only when expressly stated in the auction listing. Unless otherwise noted, all items will ship. When local pick-up is offered, all property must be removed within the stated pick-up window or within any extension approved by the Auctioneer in writing. 8. Storage and Abandoned Property All items must be picked up or have shipping arranged within two (2) weeks of the auction close, unless otherwise agreed in writing by the Auctioneer. Items remaining beyond that time will incur storage charges of: $10.00 per lot, per day regardless of size or value. If property is not paid for, picked up, or shipping arrangements are not completed within the required time, the Auctioneer reserves the right to assess storage charges, transfer the property to storage at the buyer’s risk and expense, cancel the sale, resell the property, or exercise any other rights permitted by law. 9. Third-Party Services and Consignor Disclosure Best Estate Services, Inc. acts as auctioneer and agent for consignors and third-party sellers and, unless expressly stated otherwise, is not the owner of the property offered for sale. Best Estate Services, Inc. may use third-party service providers in connection with the auction, including but not limited to BidSquare for online bidding, Shipping Saint for shipping coordination, payment processors, carriers, packers, freight companies, and other service providers reasonably necessary to administer the sale. By registering and bidding, each bidder authorizes the Auctioneer to share the information reasonably necessary to complete the transaction with such providers. Descriptions, condition statements, provenance information, and other lot information may be based in whole or in part on information supplied by the consignor or obtained from third-party sources. While Best Estate Services, Inc. endeavors in good faith to accurately identify and describe each lot, the Auctioneer does not guarantee the completeness or accuracy of such information and shall not be liable for errors, omissions, or misattributions. Third-party providers are independent contractors. Best Estate Services, Inc. shall not be responsible for delays, errors, service failures, loss, or damage caused by any third-party platform, shipper, carrier, or service provider. 10. Auctioneer’s Rights The Auctioneer reserves the right, in its sole discretion, to withdraw any lot, reject any bid, reopen or extend bidding, divide or combine lots, cancel or reschedule any sale, refuse service, require proof of identity or funds, or resolve any dispute as it deems appropriate. The Auctioneer’s records shall be final and conclusive in the event of any dispute concerning bidding, payment, or the sale of any lot. 11. Limitation of Liability To the fullest extent permitted by law, Best Estate Services, Inc., its officers, employees, agents, representatives, and consignors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the auction, any lot, bidding, payment, shipping, storage, pick-up, or the use of any third-party service provider or online platform. In any event, the maximum liability of Best Estate Services, Inc. with respect to any lot shall not exceed the hammer price actually paid for that lot. 12. Acceptance of Terms By registering, bidding, purchasing, or otherwise participating in this auction, each bidder and buyer acknowledges that they have read, understood, and agreed to these Terms & Conditions in their entirety.
