Agreement for Participating in the Auction

This document is a legal agreement between you (whether an individual or an organization) and Edens Auctions, Inc. (referred to as �EA�) regarding your participation in this auction.

Before you register and place bids, it is important that you carefully read and understand the terms and conditions outlined in this agreement. Please note that all items are sold in their current condition, and by placing a bid, you agree that you cannot request a chargeback claim due to delays in item delivery beyond your expected date or losses caused by third-party delivery services.

For purchases involving gold and silver items, credit cards will not be accepted for items that are to be shipped, items that are to be shipped will have to wire transfer, unless you are a regular customer of EA and collect items in person. a 3% fee applies to all credit card purchases.

No Warranties

All items are sold �As Is,� and EA does not provide any warranties or representations regarding the items being sold. Any implied warranties, such as merchantability or fitness for a specific purpose, are explicitly disclaimed by EA. Statements made in the catalog, during the auction, or online should not be considered as warranties or admissions of liability unless they involve a material and intentional misrepresentation of the item.

Special Terms for Gold and Silver

Items containing gold and silver are also sold in their current condition. EA may provide descriptions, but it remains your responsibility to assess the condition, value, and accuracy of the description. EA will not be held responsible for any errors or omissions in the item descriptions unless they involve a significant and deliberate misrepresentation. Coin grading is a subjective opinion, and EA does not guarantee coin grades.

If you question the authenticity of a coin after receiving it, you have 10 days to return it to EA in its original holder, unopened. EA may refund the purchase price and shipping or determine the coin�s authenticity through a third-party grading service, it the discretion of EA. If the coin is found to be genuine, you are responsible for grading and shipping costs. If the coin is deemed not genuine, EA will refund the purchase price, shipping, and grading costs.

Bidders

EA reserves the right to cancel bids, block bidders from participating, and take these actions at its discretion, with or without reason. EA may also request identification information from registered bidders to confirm their identity.

All sales are final, and placing a bid is a binding commitment. There are no returns or exchanges, so please bid carefully.

By bidding, you agree to the terms of this agreement. All bidders must be 18 years of age or older.

Auction Dates and Times

Auction dates and times may change without prior notice.

Withdrawal

EA has the right to withdraw any item or property from the auction at any time before the actual sale regardless of the number and amount of bids.

No Gold and Silver Onsite

Gold and silver items are not available onsite except during specified preview dates and times.

Sales Tax

Mississippi does not require sales tax on gold and silver bullion, effective July 1, 2023. For items where sales tax applies, it will be charged at a rate of 7%.

Buyer Premium

A 15% buyer premium will be added to your successful bid.

Payment Options

Payment Instructions

You will receive an invoice at the end of the auction, including the buyer premium and taxes if applicable. Shipping and insurance charges will be provided if applicable and must be paid before shipping. Wire transfers must be received within five days of the auction�s end. Failure to pay within three days may result in your credit card being charged, unless your invoice exceeds $2,000.No chargebacks or payment reversals will be accepted.

All payments are in US dollars.

Shipping Instructions

Items should ship within 5-7 days after payment is received. EA strives to ship as quickly as possible.

Preview Date & Times

Items are generally available for preview at the gallery on specific dates to be announced, excluding gold and silver.

Pickup Dates

Items purchased must be picked up within five (5) days of the auction at 3720 Flowood Drive, Flowood, MS 39232.

Governing Law and Venue

This agreement is governed by Mississippi state law. Any claims submitted for arbitration and subsequent litigation will exclusively take place in Rankin County, Mississippi, where all obligations under this agreement are performed.

Notices

Notifications to you will be sent via email to the address provided during registration. Notifications to EA should be sent to beau.edens@edensauctions.com or through certified mail to Edens Auctions, Inc., 3720 Flowood Drive, Flowood, MS 39232.

Waiver, Release, and Limitation of Liability

By participating in EA Auctions, you waive and release any claims against EA, its owners, members, managers, officers, employees, agents, attorneys, and representatives. This includes claims related to EA�s alleged negligence or any challenge to the title or authenticity of purchased items. This waiver and release apply to all claims, whether known or unknown, and are effective as a bar to such claims.

You assume all damages resulting from your use of EA services and sites. To the maximum extent permitted by applicable law, EA and its affiliates are not liable for any special, incidental, consequential, or punitive damages arising from this agreement or your use of their services. You also waive your right to a jury trial. If a successful claim is made EA will be liable only up to the amount of your purchase.

If, for any reason, EA is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of EA, if any, shall be the return of monies paid in respect of such Purchase upon its return by Purchaser.

Debt Collection and Interest Charges

The buyer agrees to pay all reasonable attorney fees and other costs incurred by EA in its efforts to collect funds from any buyer that fails to pay, or if payment is not final. The buyer agrees that a fee of 5% of the outstanding balance per month be added to any unpaid balance due EA.

Bidder Information and Security

All registration information the bidder provides to EA shall be current, complete, and accurate. All bidders are responsible for any bids placed under their bidding numbers and passwords. The security of bidder information is the responsibility of the bidder. Bidders must notify EA if they believe that their bidder number and password have been compromised.
