Listing Terms and Conditions
Buyer’s Premium & Taxes
A 15% online buyer’s premium applies to all purchases and will be added to the high bid to determine the total purchase price. Applicable sales tax will also be added unless a valid tax exemption certificate is provided prior to bidding.

Condition of Items
All items are sold "AS IS, WHERE IS" with no warranties or guarantees, expressed or implied. Buyers are encouraged to inspect items prior to bidding. No refunds, returns, or exchanges will be allowed. It is assumed that all bidders have inspected the assets or waived their right to do so and accept the items in their current condition.

Registration & Payment
Bidders must register with a valid credit card and authorize a minimum balance verification of $100. Registration is free. The card on file will be charged immediately following the auction for invoices under $2,000 not involving rolling stock.

Identity/Credit Verification:
To verify the identity of the cardholder and that the credit card used is valid, we require a $100.00 authorization hold to be placed on your credit card to complete your registration. This hold will be removed by your bank in a 24/48-hour timeframe (varies bank to bank). Bidding rights are provisional, and if complete verification is not possible, The Swicegood Group, Inc. will cancel your registration, and bidding activity will be terminated. The Seller and The Swicegood Group, Inc. reserve the right to refuse service to any person who they feel to be fraudulent.

Payments under $2,000: Credit card only (Visa, Mastercard, Discover).

Payments over $2,000 or involving rolling stock: Certified check or wire transfer required within 24 hours.

Declined cards: $25 fee.

Pickup & Removal
Buyers are responsible for removing all purchased items. All items in a lot must be removed or a clean-out fee may apply. Items not removed by the designated date will be forfeited unless prior arrangements are made.

The auction company does not assist with loading, packing, or shipping.

All shipping is the sole responsibility of the buyer.

Staggered & Soft Close
Auctions may use a staggered ending format and soft close system. Bidding time will be extended if bids are placed in the final minutes.

Timed Closings & Auto-Extend Feature
Online auctions are timed events, and all bidding will begin to close at a specified time. Online auctions also have an auto-extend feature. Any bid placed in the final few minutes of the auction will automatically extend the auction minutes from the time the bid was placed. Example: If an auction is scheduled to close at 6:00 and we receive a bid at 5:59, the close time will automatically extend the bidding window. The auto-extend feature will continue all lots until the bidding has ended. If the auto-extend time needs to be increased or decreased, The Swicegood Group, Inc. may do so at any time during the auction until the close of bidding.

Outbid / Back-In Notification / Max Bid
During this auction process, there is a chance that you will be outbid. If you have the bidding app, you will receive a popup notification; otherwise, you will receive an email. It is the responsibility of the bidder to realize and maintain their desired bidding position. You may place a maximum (max) bid, which allows the system to automatically bid on your behalf up to that amount. If you place a bid and immediately get a message that you have been outbid, this means another bidder has already placed a higher max bid. You will need to continue bidding until your bid exceeds the previous max bid.

Property Information & Inspection
The Swicegood Group, Inc. is not responsible for any missing or incorrect listing information. The Swicegood Group, Inc. has attempted to provide accurate descriptions; however, it is the Bidder's responsibility to conduct inspections to determine the condition and feasibility of the Bidder’s intended use. Descriptions that are provided by The Swicegood Group, Inc. are provided in good faith and are matters of opinion. It is automatically acknowledged by registering that you have personally inspected the property, hired an agent to inspect the property, or waived your right to inspect the property. Placing a bid creates a contractual agreement to purchase the property at the high bid price plus a Buyer’s Premium and any additional fees included in the closing of real estate.

Inspection & Description
Descriptions are provided as a guide only. The auctioneer and seller make no guarantees as to the accuracy. Bidders are solely responsible for determining the condition and value of the items.

Auctioneer Authority
Auctioneer may bid on behalf of the seller unless the auction is advertised as absolute. Auctioneer reserves the right to refuse service, deny registration, or remove any participant.

Auctioneer's Discretion
The Swicegood Group, Inc. has full discretion to modify the date and time, order, and details of the auction for any reason or no reason at all, including but not limited to technical issues, emergencies, and the convenience of The Swicegood Group, Inc., or the Seller. Auctioneer does not preclude the right of any employee, stockholder, or subcontractor the right to bid on any auction. The auctioneer reserves the right to bid on behalf of the seller unless the sale is an absolute auction per Uniform Commercial Code (UCC).

Risk & Liability
Ownership transfers at the fall of the hammer. Buyers assume all risk and responsibility for purchased items immediately. The auctioneer and seller are not liable for damage, theft, or injury post-sale.

Additional Legal Terms

All sales are final.

No bid retractions allowed.

Auctioneer not responsible for technology failures.

Bid increments are controlled solely by the auctioneer.

Governing law is North Carolina; venue is Davie County.

Participants waive the right to a jury trial.

Special Provisions for International Bidders
International bidders must submit a $1,000 refundable deposit to bid. This is applied to purchases or refunded if no purchase is made.

Motor Vehicles & Rolling Stock
Payment must clear before vehicle/equipment release. Certified check or wire transfer only.

Insurance Requirements
Any work or removal performed by buyers or their agents must carry proper insurance coverage, including general liability and workers' compensation.

Contract Formation
These terms constitute a binding contract between buyer and seller upon winning a bid. No further documentation is required.
