David Lingle Manufacturing Online Auction - Terms & Conditions

All bidders are required to read, understand, and agree to the following terms and conditions before placing bids. Registration and bidding constitute acceptance of these terms in full.

GENERAL TERMS

Buyer's Premium:
A 10% buyer's premium will be added to the final bid amount on all items.

Absolute Auction & Reserve Lots:
This is an absolute auction, and all items will be sold to the highest bidder, regardless of price - except for Auction Lots #125 through #152 (lumber). These specific lots are subject to seller confirmation. The seller reserves the right to accept or reject the high bid on those lumber lots.

As-Is, Where-Is:
All items are sold strictly "as-is, where-is," with no warranties, guarantees, or returns. Bidders are strongly encouraged to attend the inspection and verify condition prior to placing bids.

Location: 104 S. Knoxville Ave, Russellville, AR 72801
Preview/Inspection: Tuesday, August 19th, 10:00 AM - 2:00 PM
Bidding Opens: Monday, July 29th at 10:00 AM (CT)
Bidding Closes: Wednesday, August 20th at 2:00 PM (CT)

Load-Out & Removal:
- Thursday, August 21st | 9:00 AM - 5:00 PM
- Friday, August 22nd | 9:00 AM - 5:00 PM
- Saturday, August 23rd | 9:00 AM - 12:00 PM

A forklift will be available during load-out on a first-come, first-served basis. Buyers are encouraged to bring their own equipment, tools, and adequate help. Wooley Auctioneers staff will not assist with loading.

BIDDER REQUIREMENTS

To participate, bidders must provide a valid name, mailing address, phone number, email address, and credit card.

PAYMENT TERMS

Payment Deadline: All invoices must be paid in full immediately following the auction's close. The credit card on file will be charged for the full amount, including buyer's premium and applicable sales tax.

Accepted Payment Methods:
- Visa, MasterCard, American Express, Discover
- Cash
- Cashier's Check
- Wire Transfer

Personal checks are not accepted.

Credit Card Policy:
- A 3.5% surcharge applies to all credit card transactions.
- Credit cards are accepted only for purchases under $1,500.
- Purchases over $1,500 must be paid via cash, cashier's check, or wire transfer.

Declined Cards:
A $25 fee will be charged for any declined card that requires additional contact or reprocessing.

Prior to Pickup:
All payments must be completed before item removal. If a third party will be picking up on your behalf, contact Auctioneer Brad Wooley at (501) 940-3979 prior to their arrival to arrange payment.

Authorization Notice:
By registering and bidding, you authorize Wooley Auctioneers, Inc. to charge your card on file for all winning bids and associated fees.

Currency:
All transactions will be conducted in U.S. Dollars (USD).

Important:
Your bid is a binding contract. Do not bid unless you are prepared to pay in full and remove your items during the scheduled load-out window.

SHIPPING
Shipping is not provided.

All shipping must be arranged independently by the buyer and completed during the scheduled removal period.

The auction company will not coordinate with carriers after this period. Contact your shipping provider for a quote before bidding on large or heavy items.

FAILURE TO PICK UP

All items must be removed during the published load-out period. Items not removed will be forfeited, with no refund issued. Ownership will revert to the seller, and removal/haul-away fees may apply.
The real estate is under contract - all items must be removed on time. If you cannot comply, please do not bid.
If removal will be an issue, you must contact the auctioneer before the auction closes.

INTERNET BIDDING NOTICE

This auction is conducted entirely online as a convenience to bidders.

Wooley Auctioneers is not responsible for missed bids due to connection issues, device errors, or system problems.

To avoid issues, use the "maximum bid" (proxy bidding) feature and place your bids at least 24 hours in advance.

The auctioneer reserves the right to withdraw or re-catalog items at any time.

SPECIAL CONDITIONS OF SALE

- All sales are final. No refunds, returns, or exchanges.
- All items are sold "as-is, where-is."
- Bidders must be at least 18 years old.
- The auction progresses quickly - bid promptly.
- The auction company reserves the right to refuse service to anyone.
- Any legal disputes will be resolved in Pulaski County, Arkansas.
- Online terms override any printed or verbal representations.
- Descriptions are provided to the best of our ability but are not guaranteed. Bidders are encouraged to inspect items in person.
- By placing a bid, you agree to abide by all terms and conditions of this auction.

SOFT CLOSE NOTICE
This auction uses a soft close. If a bid is placed within the last 60 seconds of an item's countdown, the bidding will be extended by one additional minute. This process will repeat until no further bids are placed, preventing last-second "sniping" and ensuring fair bidding.
