Bring Backs: In the event of an emergency, you are unable to attend the pickup, the auction company can provide transport for (small, manageable) items to be taken to our office in Farmland for a pick up within 72 hours. There will be a $5.00/ item fee added to your bill. Please note that this is in a per person basis and arrangements MUST be made in advance. Shipping: After your initial payment for your purchase, your card on file will be charged for the cost of shipping plus a $5 per packaged box. We try and ship your items via USPS. Some items due to size or weight will need to be shipped via USPS. We have had too many issues with FedEx (lost packages, broken packages, etc) so we prefer not to use them. Terms & Conditions: The Sale of Items- Wagner Auctioneering and Real Estate has the right to terminate the auction at any reasonable time; withdrawal from sale any item; to sell at this auction items not listed; to group one of more lots into one or more selling lots or to subdivide into two lots or more selling lots. Wagner Auctioneering and Real Estate also reserves the right to sell all of the items listed in bulk. No Liability- Wagner Auctioneering and Real Estate assumes no liability for your purchases (if you buy a lawnmower, bulldozer, or other such item, and you don't know how to use it and get injured, we are not liable). The buyer assumes and does agree to indemnify and hold the Auction Company and seller harmless from any future claim that shall pertain to the fitness or use of that asset being purchased. Documents- All documents must be completed in full by buyers and sellers. For example: Death Certificates, Letters of Authority, Creditor Liens, and UCC's when purchasing vehicles, firearms, etc. Loading Equipment- Wagner Auctioneering and Real Estate does not lend, lease, or borrow any equipment, nor deliver sold goods. Consignors- All consignors must fill out a contract with Wagner Auctioneering and Real Estate, sign forms and abide by our terms listed. Bidders- All bidders must register for bidder's numbers with proper ID. Payment- Purchases must be paid in full within 24 hours of conclusion of the auction. Payment may be made by Visa, MasterCard, American Express or Discover with no extra fees. Wire transfers will incur an extra fee. Buyer specifically waves the right to dispute or deny payment for any purchases made with credit card. Removal- No goods will be removed until paid in full. Purchaser is responsible for removal of all purchased items. No abandonment of purchased items is allowed. Purchaser will be responsible to pay the full cost of removal or disposal of abandoned items. Wagner Auctioneering and Real Estate shall not, in any event, be liable for non-removal or abandonment or for any other matter to any purchaser of any lot. Paid Receipt- Removal of purchased items shall be at the expense, liability, and risk of the purchaser. Purchases can be removed upon presentation of paid receipt to Auction staff. Purchased goods must be removed within the parameters listed in the auction description or sold for storage in our upcoming sale. NSF Funds- A fee for Non-sufficient Funds (NSF) checks per occurrence will be charged. NO CREDIT ALLOWED Reserve Prices- We are governed by the Indiana Statutes and all items sell with a reserve unless advertised. Wagner Auctioneering and Real Estate has the right to publish or disclose any minimum due to confidentiality. Vehicles sell with owner's confirmation. Bidding- No consignor, seller, or agent for seller has that right to bid on their consigned goods. Employee Bidding- Any employee of Wagner Auctioneering and Real Estate may bid at any auction if they so wish to purchase an item. Compliance with The Terms of Sale- In default of payment of bills in full within the time announced for this auction the Auction Company in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages. Dispute between Bidders- If there is any dispute between two or more bidders, the auction company or its' auctioneer, may decide the successful bidder. Condition of Items Sold- All information is believed to be accurate, but the auction company shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold "as is" and without recourse. Nominal bids- Any bid that is merely a nominal bid may be rejected by the Auction Company or the Auction Company may reject fractional advances, if in their judgment it may adversely affect the sale. Absentee (proxy) Bids - Absentee bids may be presented to the auction company in writing and must be accompanied by credit/debit card number, which will be verified for you maximum bid amount and applicable Buyer's Premium prior to the sale. Buyer may deliver to auction company maximum bid in certified funds to be refunded in full, if Buyer does not gain the successful bid. Said bids are subject to all terms and conditions of sale as listed herein or announced at the auction sale. All absentee bids will be held in confidence. Due to the selling of the house, we have been tasked with liquidating the contents of the house for the Cook family. 1 Wooden Wall Clock Wooden pendulum wall clock, appears to be in good condition. Does have key as well. Made by Wentworth, ornate top, wooden frame, was not wound to test. 2 Harley Davidson Diecast Replicas Several Harley Davidson diecast replicas, several included, various scales. Comes with picture as well as small diecast car. 3 35mm Cameras & Tasco Spotting Scope Set of two 35mm cameras, one is Vivitar brand, other brand unknown. Comes with small Tasco spotting scope, comes with original box. 4 Books Small amount of books, comes with medical book, Amish cookbook, Complete Everyday cookbook and Children's Bible Story book. All appear to be in good condition. 5 Kit Type Bookshelf Pressed wood, kit type bookshelf, good condition, DOES NOT COME WITH ANY CONTENTS. Good condition, Sauder type material, measurements in photos. 6 Porcelain Dolls Set of porcelain dolls, Geisha type dolls, comes in display case with glass sides. Look to be in good condition. 7 Imperial Glass Basket Small Imperial glass basket, twisted handle, floral type design, appears to be good. Mark is present on bottom. 8 Pocket Knives Small amount of small inexpensive pocket knives, two multi-tools, along with nail clippers and manicure set. 9 Violin Music Box Small wooden violin music box, does have stand and bow. Wound but did not play. Still a nice little decor piece. 10 Chest of Drawers Kit type chest of drawers, light duty, pressed wood material. Very nice condition, some engraving on top drawer, clean, measurements in photos. 12 Lighthouse Wall Clock Small lighthouse wall clock, battery operated, good condition, will need new set of batteries. 13 Angels Large set of angels, all appear to be in good condition., various materials. 14 Figurines & Tea Kettle Small amount of various figurines, comes with small ceramic tea kettle as well as small dish or planter. All look to be in good condition. 15 Framed Print, Wooden Shelf & Praying Hands Small wooden frame print, wooden decor type shelf and ceramic or plastic praying hand statue. 16 Child's Rocker Wooden child's rocker, appears to be in good condition, slat type seat, all wooden construction. 17 Jewelry Box Small upright jewelry box, great for necklaces, glass front door and mirrored back. 18 Vintage Gloves, Moccasins & More Set of white vintage ladies gloves, vintage hanky, handmade set of moccasins, and baby shoes, all look to be vintage. 19 Glass Nativity Set Small set of glass nativity, does have a couple of non-glass animals, all look to be in good condition. 20 Chest of Drawers Set of pressed wood chest of drawers, good condition, does have some engraving on top drawers. Good condition and clean, matches lot 10. 21 Wooden Rocker Glider Wooden rocker glider, good condition, does come with pad and throw, sits well and works as it should. Solid wood construction. 22 Teddy Bears Large grouping of teddy bears, all appear to be in good condition, all sizes and types. Some other stuffed animals or stuffies mixed in. 23 Cedar Chest Bench style cedar chest, no name, good condition, lid opens, measurements in photos. 24 Home Decor Items Small amount of home decor items, comes with small mirror that resembles a window and small amount of silk flowers. 25 Pocket Watch 20 Cent piece pocket watch, looks to be in good condition. Comes with wooden padded case, new condition, made by Coilbri. 26 Zippo Pocket Knife Zippo brand pocket knife, engraved with fishing scene. Looks to be in new condition. Comes with felt case. 27 Playstation Gaming Systems Set of Playstation gaming systems, one is original Playstation and other is PS2, comes with several games, both PS1 and PS2 games. Comes with controllers as well. 28 Wooden Stand Small wooden stand or footstool, appears to be handmade, good condition. 29 Office Supplies Several office supplies, comes with rubber bands, pens, pencils, tape and more.
