The offering and sale of property by�Estate Downsizing Specialists,�LLC (EDS) is subject to the following conditions of sale, as modified or supplemented by other written provisions and/or in announcements made by the auctioneer, prior to or at the time of the sale.

YOUR BID IS YOUR CONTRACT TO BUY. All auctions are considered reserve auctions unless otherwise posted. EDS and its employees reserve the right to bid on any item for any reason, including absentee bids placed by non-internet bidders and reserve bids placed by EDS staff on behalf of our sellers.

BUYER�S PREMIUM: All bidders will pay an 18% buyer�s premium. Buyer�s Premium for Specialty and Automobile Auctions may vary, see individual auction descriptions for details.

REMOVAL of PURCHASED LOTS: Items may be removed from the auction house by the buyer after the invoice has been paid. Removal shall be at the expense, liability, and risk of the purchaser. EDS shall not be responsible for items not collected by close of business on the Friday of the week of the auction. Lots not paid for and/or removed within this time frame may be resold at public or private sale without further notice.

PAYMENT: EDS accepts cash, major credit cards, Zelle, wire transfer, personal checks (with a hold until payment clears) and certifiable funds. Nothing will ship until payment is clear and certified to our bank.

Buyers will be contacted via email by Shipping Saints after the auction closes; buyers must click on SHIPPING or PICK UP within this message. EDS makes every effort to contact buyers, however, it is the buyers' responsibility to communicate with EDS to arrange pick up or shipping. Purchased items will not be stored at the EDS facility beyond the week of the auction and will be considered forfeited.

Gold, Numismatics, Sterling Silver or purchases over $1000 REQUIRE CONFIRMED FUNDS for new buyers with EDS, such as ACH, Bank or Wire Transfer, as well as proof of identity. Restrictions on shipping of gold and other items may apply. The full purchase price and all applicable taxes and fees are required before removal or shipping of any items.

REQUEST FOR INFORMATION: Requests for additional information and/or photos will be handled as received. Timely replies may not be possible if received within the final 3 days before an auction closes.

TERMS OF SALE: A bid on any lot offered by EDS indicates the buyers� acceptance of the Terms of Sale. Any participation in the auction binds you to the agreement of these terms, whether you read or understand said terms. The Terms of Sale in writing contained herein are subject to change without notice. The bidder agrees that the most recently published Terms of Sale, as published or amended on the website at the beginning of the auction, shall apply.

DISCLAIMER: All items presented for sale are estate or downsizing items and are used merchandise unless specified as new. Do not assume anything will be included with used items unless they are described and pictured in our listings. Neither we, nor the consignor, make any guarantees, warranties, or representation expressed, or implied, regarding the property or the correctness of the description, of the authenticity of authorship, physical condition, size, quality, rarity, importance, provenance, exhibition, literature, or historic relevance of the property or otherwise. RETURNS, DESCRIPTIONS and GRADING: EDS staff are not professional graders or experts, though we make every effort to give our best analysis of condition, grade, and quality. Items graded by third party grading companies such as PCGS are listed as described by the grader. All items are sold as-is and all sales are final. EDS makes no warranties or guarantees of condition. It is the responsibility of the bidder/buyer to establish the authenticity, grade, details, flaws, provenance, and authenticity of all lots by personal preview. Because of the level of fraud encountered in this industry, it is important that buyers understand this responsibility prior to bidding. All sales are final.

YOUR BID IS A CONTRACT TO BUY: Bidding in an EDS Auction is your contract to purchase. Effective and enforceable immediately when you become the high, winning bidder, you have agreed contractually to your purchase per the laws of the State of Indiana. All bidders must be 18 years of age or older and competent to conduct a financial transaction. EDS makes every effort to accurately describe all lots. We will make every effort to accurately describe all items - descriptions, marks, identification, and photographs of the items will not be considered a warranty or guarantee of authenticity or value. The bidder/buyer agrees to pay all costs associated with any collection process for funds due to EDS. This may include legal and court fees, time, and ANY associated costs. The purchaser agrees that a fee of 10% per month will be added to the balance of any unpaid amount due to EDS. This will include ANY and ALL costs associated with collection, including damages.

NEW LOTS MAY BE ADDED: New lots may be added to any of our auctions up to the Friday before the Monday close of the sale.

BIDDING: Auction lots will have a staggered ending time starting at 6pm or 7pm EST, depending on the season, with most auctions closing on Mondays and Wednesdays. All EDS auctions have soft closing times. Stagger time varies per auction depending on the total lot count. Any bids placed in the last two minutes of time remaining will extend the total time. If two bidders place high bids that are the same amount, the FIRST recorded bid becomes the winner. Make sure you have the high bid before assuming you have purchased an item. EDS assumes no responsibility or liability in the bidding activities during the close of the auction. Once an item is closed, EDS cannot change the winning bidder status under any circumstances. EDS reserves the right to withdraw any bid for any reason.

ADDITION TO OR WITHDRAWAL FROM SALE: Seller or Auctioneer may withdraw or change the items being sold in this event at any time and at their discretion.

SALES TAX: 7% Indiana Sales Tax will be charged for all buyers with Indiana residence. If you have a Tax Exemption, we must have your Exemption Certificate on file before the close of the auction. No Lots will be released on a Tax-Exempt basis until EDS has a current copy ON FILE. Certificates can be emailed to EDSOnlineAuctions@Gmail.com.

SHIPPING: In-house shipping is available on some, but not all, lots. Additional charges will be due and paid separately for shipping and handling. Please know that shipping fees are not determined by the price you pay per lot but by the size, weight,�cost of packing material, and labor. You will be given an invoice after items have been packed that you can pay online. Prices are not negotiable.�KINDLY DO NOT HAGGLE WITH US over packing and shipping prices. By shipping in-house, we control the packing quality, ship more quickly, and less expensively than third-party shippers.Your purchase is insured in transit against damage. EDS Fine Estate Auctions presents a selection of Native American Lithic Artifacts from the Garrett Collections. This collection features artifacts from his finds and collections with the earliest items marked from Dennis Garrett's childhood in the1940's. Dennis was a prolific hunter and collector, as items range from personal finds to many items bought from hunters and collectors during his years in the antique business. He frequented the GIRS shows in Columbus, Owensboro and other locations, always looking for those special finds. As with any major artifact auction we brought them to Davis Artifact of Frankfort KY to look at the Garrett collection, including having them grade some items. Everything in this auction was either looked at by Davis or is being sold in the original frames with tags and as much history as possible. This is the last session of this collection. Hardstone, slate, flints & cherts, bone and unusual examples are throughout this auction. A great selection of spear points and fine flints. We will be adding to this auction. Dennis & Nancy Garrett were the owners of The Garret Antique Shop in Bloomington IN. Dennis was a prolific collector, hunter, and dealer in Native American artifacts, rocks & mineral, fossils, shells & natural specimens for the Bloomington community for over 50 years. Dennis practiced the dealer/collector motto with great passion, "Keep the Best & Sell the Rest" . We are pretty sure he NEVER sold a rock or artifact he felt was special. Dennis Garrett was an avid rock hound and collector, traveling far & wide to buy and known throughout the collecting community. The rock shop was referred to as Garrett's Grotto.
