2025 Auction Terms & Condition

All Bidders acknowledge to have read, comprehend, and agree to the following terms & conditions set forth by Jeff Boone Auction & Realty. ("Boone Auctions"). All bidders agree to be legally bound to these terms & conditions. All announcements made by the Auctioneer shall supersede any printed material.

Boone Auctions reserves the right to deny and or terminate bidding privileges at any time.

Buyers: Once invoiced, you have 24 hours to contact Boone Auctions to notify of payment arrangements. Please note that any purchase is subject to automatically be charged to your credit card on file. If you prefer to pay another way, please contact us immediately following the Auction with your bidder number and invoice number to inform us on your payment & pickup details, by emailing us at JeffBooneAuctions@gmail.com. Boone Auctions has the right to charge your card on file if no communication has been made on payment preference.

Payment Terms: Cash & Check accepted with no extra fee - Wire Transfer accepted with a $20 fee from the Auction company that will be added to your invoice before payment - Credit & Debit Cards accepted with a 3.99% charge in addition to the purchased amount.

For successful Buyers, A 12% buyers premium will be charged to the total invoice price. 5% BP on the Viper, you will see 12% when bidding but it is only 5% on Lot # 1 the 2005 Viper. Reach out with any questions

7% Indiana State Sales Tax will be charged unless proof of exemption is provided. All titled items will be charged sales tax at the rate of where your vehicle will be titled up to a max of 7% unless purchased by a registered dealer. This applies to in state and out of state purchasers.

All bidders understand that they will be liable for payment of sales or use taxes which may become due for failure to comply with the provisions of federal, state, and local tax codes for any items sold as tax exempt or for resale. All bidders understand that it is a criminal offense to give an exemption certificate to the seller for taxable items that they know, at the time of purchase, will be used in a manner other than that expressed in this certificate and, depending on the amount of tax evaded, the offense may range from a class c misdemeanor to a felony of the second degree.

Attention: Purchasers must pick-up items during the following times. Monday, July 21st & Tuesday, July 22nd from 9 AM till 5 PM.
Unless special arrangements or shipping requests are made with the auction company, ANY items not picked up during these times will be set outside, and subject to be sold or discarded immediately following the last day of pickup. Due to other upcoming Auctions that we need to prepare for, our building and lot need to be cleared out during our allotted times. The Auction company is not responsible for lost, stolen, or damaged items. It is the buyers responsibility to insure purchases as needed immediately.

Shipping: Shipping fees from the major carriers can be very expensive. Our team will do their best to pack in the most efficient way, but carrier fees may still be high. For ANY fragile, glass, or breakable items there will be an extra $10 handling fee on top of the normal carrier fees for time and packing materials. Cabinets, Desk, bed frames, and other large items are not available for shipping. Please email us if you have questions or would like to inquire about a certain item being shipped. Pick-up deadline does not apply to those having items shipped. Auction company will send those to our shipping department accordingly.

All items must be paid for by Tuesday, July 22nd @ 5 PM EST unless prior arrangements have been made. Any unpaid bills will result in revoked bidding privileges/immediate legal action. If mailing a check for payment, buyer must send priority mail with a tracking number.

There will be a Titled Vehicle Entry Fee added to all Titled items $20 Paid by Seller & $40 Paid by the Buyer. Fee includes: Title processing (paperwork filled out and documents needed to take to your local BMV), and USPS Priority Mail (with tracking number) delivery, if applicable. Cash buyers on titled items may take the title upon payment if the title is present. Those paying with checks will receive title upon check clearing. For items noted �Title to Arrive�, titles may take up to 30 days to come in if obtaining from a lender, and or waiting to receive from the BMV. Boone Auctions will secure titles and distribute as soon as possible for each titled item. Items that say "Title to Arrive" or "Title Present" will have a title. If it does not mention a title, assume that there is not one, and that is how that item is being sold.

Immediately when an item is Sold it becomes the property and responsibility of the Buyer. All items sell �AS-IS� �Where-Is� with no warranties or guarantees by the Seller(s) or the Auction company. All sales are Final. The described condition or representation of hours, use, and miles is provided as a courtesy, and not guaranteed by the Seller(s) or the Auction company. The Bidder is responsible for determining his or her opinion of the condition, and authenticity of an item before purchasing the item, not after. It is the buyers responsibility to inspect the item of interest prior to bidding on it. Online Bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder�s responsibility to determine condition, age, genuineness, value or any other determinative factor. (Boone Auctions) shall endeavor to describe in detail each item and any pertinent information about it. After a bidder has won the bid, all risk of loss and damage passes to the bidder, even though the bidder may have not paid for the item yet. Buyers should guard their items accordingly. The Seller(s) and the Auction Company and all of its Associates are not responsible for loss, theft, damages, or accidents.

By placing bids you agree to follow all of the terms and conditions, agree to make payment, and to take possession of purchased items. Although we strive to provide the best internet connections and software available, please understand that internet speeds and reliability will vary.

The Auction company is not responsible for lost connection or software failures that result in lost or unaccepted bids. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against (Boone Auctions) or anyone else if the Internet service fails to work correctly before or during the live auction. (Boone Auctions) will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should leave their maximum bid 24 hours before the auction begins, and confirm with the auction company if the bidder has any doubts about the process. Do not hesitate to bid or wait until the final seconds. This will be a fast paced auction and quick bidding will be required.

All online bidders are responsible for complete control of their online bidding accounts. You are 100% responsible for every bid placed under your account, accidental and intentional. Online bidding is a serious matter. You must understand exactly what you are doing at all times.

Although we strive to do this as little as possible, (Boone Auctions) reserves the right to withdraw or re-catalog items at any time.

Boone Auctions will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as-is and that they may not return any item they purchase.

All bidders agree to receive text, email, & or postage notifications about our upcoming events.

All auctions are considered to be with reserve unless specifically stated otherwise. Reserves, if any, are not disclosed.

4473 Background Checks are required for all firearm purchases excluding black powder. Buyers Premium includes 4473 Processing Fees at Jeff Boone Auction and Realty. Buyers responsible for FFL processing fees for their receiving FFL Dealer. Qualified buyers may take their firearm purchases with them. For any bidder who is not legally allowed to own and or possess a firearm, bidder will lose 100% of the purchase price. Bidders are responsible for knowing all state and local laws and regulations.

***IMPORTANT... THE PURCHASER OF A FIREARM MUST BE THE PERSON PICKING UP THE FIREARM... NO EXCEPTIONS... ITS THE LAW.

Jeff Boone Auction & Realty is not a test facility and assumes no liability for the safe function of any firearm. All customers when purchasing a firearm that are not capable of rendering a judgement for the ability of the firearm to function safely and properly should have a qualified gunsmith check the purchase before use.

Jeff Boone Auction & Realty does not warrant that you may legally purchase, resale, own or use specific products offered for sale at our auction. Local laws are constantly changing, it is your responsibility to investigate the products you wish to purchase and verify that they are not prohibited by any State or Local ordinances in your area before bidding.

Online Bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. ALL local and federal firearms laws will be strictly adhered to. Any firearm that accepts a primer fed cartridge or shell or any metallic cartridge of any kind (including those considered relic or curios) will only be shipped directly to FFL holders or the purchasers designated FFL licensee. No magazine fed semi-automatic firearm will be shipped to states that prohibit such weapons or high capacity magazines. No firearms will be shipped outside the 48 contiguous United States except to Alaska and Hawaii. After February 1, 2010, ammunition sold to purchasers in the state of California, can only be shipped to the purchaser's designated FFL Licensee. Ammo will not be shipped to Alaska.

Auction costs do not include shipping cost of the firearm items purchased at auction. Upon completion of purchase for the items(s) won at auction, it is the buyers responsibility to contact their local FFL holder to coordinate the transfer of the item(s) purchased. Purchasers local FFL holder will eventually need to email a copy of their transfer document (FFL LICENSE COPY) to �Guns@the2ndright.com�. In order for �The 2nd Right� to coordinate the transfer, it is the buyers responsibility to email �The 2nd Right� at the email address provided above with the following required information.

For shipping a minimum of $10 will be charged per package plus postage or shipping costs to the buyer's credit card. The description and condition of the firearms were provided by the seller in most cases or by an outside consultant and are assumed correct by the auctioneers and or the auction company, but are not warranted by either the auctioneer or the auction company.

2025 Auction Terms & Condition All Bidders acknowledge to have read, comprehend, and agree to the following terms & conditions set forth by Jeff Boone Auction & Realty. ("Boone Auctions"). All bidders agree to be legally bound to these terms & conditions. All announcements made by the Auctioneer shall supersede any printed material. Boone Auctions reserves the right to deny and or terminate bidding privileges at any time. Buyers: Once invoiced, you have 24 hours to contact Boone Auctions to notify of payment arrangements. Please note that any purchase is subject to automatically be charged to your credit card on file. If you prefer to pay another way, please contact us immediately following the Auction with your bidder number and invoice number to inform us on your payment & pickup details, by emailing us at JeffBooneAuctions@gmail.com. Boone Auctions has the right to charge your card on file if no communication has been made on payment preference. Payment Terms: Cash & Check accepted with no extra fee - Wire Transfer accepted with a $20 fee from the Auction company that will be added to your invoice before payment - Credit & Debit Cards accepted with a 3.99% charge in addition to the purchased amount. For successful Buyers, A 12% buyers premium will be charged to the total invoice price. 5% BP on the Viper, you will see 12% when bidding but it is only 5% on Lot # 1 the 2005 Viper. Reach out with any questions 7% Indiana State Sales Tax will be charged unless proof of exemption is provided. All titled items will be charged sales tax at the rate of where your vehicle will be titled up to a max of 7% unless purchased by a registered dealer. This applies to in state and out of state purchasers. All bidders understand that they will be liable for payment of sales or use taxes which may become due for failure to comply with the provisions of federal, state, and local tax codes for any items sold as tax exempt or for resale. All bidders understand that it is a criminal offense to give an exemption certificate to the seller for taxable items that they know, at the time of purchase, will be used in a manner other than that expressed in this certificate and, depending on the amount of tax evaded, the offense may range from a class c misdemeanor to a felony of the second degree. Attention: Purchasers must pick-up items during the following times. Monday, July 21st & Tuesday, July 22nd from 9 AM till 5 PM. Unless special arrangements or shipping requests are made with the auction company, ANY items not picked up during these times will be set outside, and subject to be sold or discarded immediately following the last day of pickup. Due to other upcoming Auctions that we need to prepare for, our building and lot need to be cleared out during our allotted times. The Auction company is not responsible for lost, stolen, or damaged items. It is the buyers responsibility to insure purchases as needed immediately. Shipping: Shipping fees from the major carriers can be very expensive. Our team will do their best to pack in the most efficient way, but carrier fees may still be high. For ANY fragile, glass, or breakable items there will be an extra $10 handling fee on top of the normal carrier fees for time and packing materials. Cabinets, Desk, bed frames, and other large items are not available for shipping. Please email us if you have questions or would like to inquire about a certain item being shipped. Pick-up deadline does not apply to those having items shipped. Auction company will send those to our shipping department accordingly. All items must be paid for by Tuesday, July 22nd @ 5 PM EST unless prior arrangements have been made. Any unpaid bills will result in revoked bidding privileges/immediate legal action. If mailing a check for payment, buyer must send priority mail with a tracking number. There will be a Titled Vehicle Entry Fee added to all Titled items $20 Paid by Seller & $40 Paid by the Buyer. Fee includes: Title processing (paperwork filled out and documents needed to take to your local BMV), and USPS Priority Mail (with tracking number) delivery, if applicable. Cash buyers on titled items may take the title upon payment if the title is present. Those paying with checks will receive title upon check clearing. For items noted �Title to Arrive�, titles may take up to 30 days to come in if obtaining from a lender, and or waiting to receive from the BMV. Boone Auctions will secure titles and distribute as soon as possible for each titled item. Items that say "Title to Arrive" or "Title Present" will have a title. If it does not mention a title, assume that there is not one, and that is how that item is being sold. Immediately when an item is Sold it becomes the property and responsibility of the Buyer. All items sell �AS-IS� �Where-Is� with no warranties or guarantees by the Seller(s) or the Auction company. All sales are Final. The described condition or representation of hours, use, and miles is provided as a courtesy, and not guaranteed by the Seller(s) or the Auction company. The Bidder is responsible for determining his or her opinion of the condition, and authenticity of an item before purchasing the item, not after. It is the buyers responsibility to inspect the item of interest prior to bidding on it. Online Bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder�s responsibility to determine condition, age, genuineness, value or any other determinative factor. (Boone Auctions) shall endeavor to describe in detail each item and any pertinent information about it. After a bidder has won the bid, all risk of loss and damage passes to the bidder, even though the bidder may have not paid for the item yet. Buyers should guard their items accordingly. The Seller(s) and the Auction Company and all of its Associates are not responsible for loss, theft, damages, or accidents. By placing bids you agree to follow all of the terms and conditions, agree to make payment, and to take possession of purchased items. Although we strive to provide the best internet connections and software available, please understand that internet speeds and reliability will vary. The Auction company is not responsible for lost connection or software failures that result in lost or unaccepted bids. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against (Boone Auctions) or anyone else if the Internet service fails to work correctly before or during the live auction. (Boone Auctions) will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should leave their maximum bid 24 hours before the auction begins, and confirm with the auction company if the bidder has any doubts about the process. Do not hesitate to bid or wait until the final seconds. This will be a fast paced auction and quick bidding will be required. All online bidders are responsible for complete control of their online bidding accounts. You are 100% responsible for every bid placed under your account, accidental and intentional. Online bidding is a serious matter. You must understand exactly what you are doing at all times. Although we strive to do this as little as possible, (Boone Auctions) reserves the right to withdraw or re-catalog items at any time. Boone Auctions will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as-is and that they may not return any item they purchase. All bidders agree to receive text, email, & or postage notifications about our upcoming events. Jr Blvd Anderson, IN 46013 **Only the registered buyer may pick up the firearm(s);** transfers to anyone else are not permitted. **A federal background check is required** and must be successfully completed before any firearm can be released. 4473 Background Checks are required for all firearm purchases excluding black powder. Buyers Premium includes 4473 Processing Fees at Jeff Boone Auction and Realty. Buyers responsible for FFL processing fees for their receiving FFL Dealer. Qualified buyers may take their firearm purchases with them. For any bidder who is not legally allowed to own and or possess a firearm, bidder will lose 100% of the purchase price. Bidders are responsible for knowing all state and local laws and regulations. ***IMPORTANT... THE PURCHASER OF A FIREARM MUST BE THE PERSON PICKING UP THE FIREARM... NO EXCEPTIONS... ITS THE LAW. Jeff Boone Auction & Realty is not a test facility and assumes no liability for the safe function of any firearm. All customers when purchasing a firearm that are not capable of rendering a judgement for the ability of the firearm to function safely and properly should have a qualified gunsmith check the purchase before use. Jeff Boone Auction & Realty does not warrant that you may legally purchase, resale, own or use specific products offered for sale at our auction. Local laws are constantly changing, it is your responsibility to investigate the products you wish to purchase and verify that they are not prohibited by any State or Local ordinances in your area before bidding. Online Bidders understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder�s responsibility to determine condition, age, genuineness, value or any other determinative factor. (Jeff Boone Auction & Realty) shall endeavor to describe in detail each item and any pertinent information about it. ALL local and federal firearms laws will be strictly adhered to. Any firearm that accepts a primer fed cartridge or shell or any metallic cartridge of any kind (including those considered relic or curios) will only be shipped directly to FFL holders or the purchasers designated FFL licensee. No magazine fed semi-automatic firearm will be shipped to states that prohibit such weapons or high capacity magazines. No firearms will be shipped outside the 48 contiguous United States except to Alaska and Hawaii. After February 1, 2010, ammunition sold to purchasers in the state of California, can only be shipped to the purchaser's designated FFL Licensee. Ammo will not be shipped to Alaska. Auction costs do not include shipping cost of the firearm items purchased at auction. Upon completion of purchase for the items(s) won at auction, it is the buyers responsibility to contact their local FFL holder to coordinate the transfer of the item(s) purchased. Purchasers local FFL holder will eventually need to email a copy of their transfer document (FFL LICENSE COPY) to �Guns@the2ndright.com�. In order for �The 2nd Right� to coordinate the transfer, it is the buyers responsibility to email �The 2nd Right� at the email address provided above with the following required information. For shipping a minimum of $10 will be charged per package plus postage or shipping costs to the buyer's credit card. The description and condition of the firearms were provided by the seller in most cases or by an outside consultant and are assumed correct by the auctioneers and or the auction company, but are not warranted by either the auctioneer or the auction company. Any/All items not transferred from �The 2nd Right� within 30 days from date of auction will become the property of Jeff Boone Auctions.
