Any Items not removed by May 8th 5:00 PM CST will be considered abandoned Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc. reserves the right to resell the items and retain all proceeds as payment for storage and handling. Please be prepared to bring any tools, equipment, and labor you need to help with your removal.

Payment: Payment in full is due at the conclusion of the auction. Payment methods accepted are: Cash, Visa, MasterCard, and Discover. Any Invoices over $ 3,000.00 require Cashiers Check or Wire Transfer.

Bidder Verification: The identity of all bidders will be verified. Bidding rights are provisional, and if complete verification is not possible, Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc. will reject the registration and bidding activity will be terminated. The Seller and Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc. reserve the right to preclude any person from bidding. Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc. reserves the right to modify, change, or remove bidders at any time.
Guaranty Agreement: By submitting a bid in the name of a business, entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees payment to Auto Auctions Inc. / Bill Colson Auction and Realty Co. Inc.
Acceptance of Bid Prices: ALL BIDS ARE SUBJECT TO SELLER CONFIRMATION. Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc and/or Seller shall make the sole and final decision as to the winning high bid amount. Acceptance by the online bidding platform does not necessarily constitute an accepted bid by Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc.
Buyer and or Bidder agrees to hold harmless and indemnify Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc and its Agents, Owners, Directors, Employees and its Representatives from any and all claims, damages or suits including but not limited to awards, judgments, costs, fees, etc.
You must be at least eighteen (18) years old and legally able to contract to bid and to purchase at the online auction. You agree to provide accurate, current, and complete information to when registering and before bidding, and to promptly update information Bill Colson Auction and Realty Co. You agree that you are responsible to maintain the security of your bidder identification and your payment information including but not limited to your user name and password, AND that you accept all risks of authorized and unauthorized use of your bidder identification and/or your payment information, AND that you will promptly pay for all winning bids made using your bidder identification and/or your payment information including the winning bid amounts, the buyer premiums, the taxes, and all other costs and expenses owed related to all winning bids made using your bidder information and/or your payment information. You agree that Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc may disapprove, suspend, or terminate any bidder registration at any time, for any reason, at Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc sole discretion, and may prohibit anyone from participating in the Auction Services. You agree that both the Seller and Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc may pursue legal actions against you if you fail to promptly pay for all winning bids for property or merchandise made using your bidder identification and/or payment information, and that the law may allow for the filing of both civil and criminal actions
You agree that the laws of the State of Tennessee shall govern this agreement, shall be applied if any dispute arises related to the Online Auction, and shall be applied related to any dispute with Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc. You agree that regardless of any statute or law to the contrary, any claim, lawsuit, or cause of action related to the Online Auction or related to Bill Colson Auction and Realty Co. Inc / Auto Auctions Inc or related to these Terms and Conditions must be filed within one (1) year of the date the bid was made or be forever barred.
