1. Online pre-bidding available for Catalog Lots from February 24th, 2025, to Auction day Saturday March 8th , 2025, followed by Simulcast & floor bidding starting at 10:00AM. Live bidding of uncatalogued items starts at 9:00am & continues after cataloged items are completed.
2. Many Uncatalogued items for the live auction including large and small commercial kitchenware, accessories, supplies & more.
3. Live Auction bidding starts on Saturday March 8th, 2025, at 9:00 am
4. For the cataloged lots, the online prebid's will be the starting bid in the live auction. Further bidding on each catalog item will be both live & Simulcast.
5. A clerk will bid during the live auction for webcast bidders as well as place bids for registered pre-bidders up to their maximum bids placed if needed.
6. At the close of the bidding for each online item, Hibid will show if a floor (live) or online bidder won the item.
7. Items can be previewed on auction day from 7:00AM.
8. Pick up is on auction day Saturday March 8th or Sunday March 9th from 10AM to 3:00PM. Additional pickup dates/times should be discussed with the auctioneer

10. All items are offered and sold "AS IS, WHERE IS" with all faults. Online Auctions Catalog Lots are noted as serviced and in working condition or in new condition.
11. NOTICE: D. Cole Auctioneering and Estate Sales LLC will not be able to hold any items for pick up beyond the stated times.

13. This auction has a 13% buyer's premium for online winning bids and 10% for on site winning bidders
14. Online winning bids will receive an invoice listing the items won. Payment is due at the time of pick up. Credit cards and cash are accepted. Cards accepted include MasterCard, Visa, American Express and Discover only.
15. A 3% Fee will be charged for CC users. 5% for American Express.
16. If you do not pick up your items on the specified date, the credit card you have on file will be charged.
17. By bidding in this auction, you are agreeing to all of the terms posted for this auction.
18. Shipping is not offered for this auction, although we will work with your Freight Company For Pickup of Items Won in the Auction.
19. Declined credit cards can result in a buyer being banned from participating in future auctions.
20. This is a public auction and not a retail setting. All sales are final. No returns or charge backs are accepted
21. Any item purchased that requires dismantlement, a million-dollar insurance certificate must be provided prior to dismantlement. A dismantlement form will be provided to the buyer prior to removal. Removal and rigging are to be at the purchaser�s own expense, risk, and liability. All rigging and delivery arrangements are strictly the responsibility of the purchaser and rigging company. D. Cole Auctioneering LLC and the owner takes no responsibility for these arrangements whatsoever. All purchases are made at the purchaser�s risk, and the auctioneer is not responsible if all or any part is lost, stolen, damaged or destroyed from any cause. This information includes but is not limited to written and/or oral descriptions, year, make, model, machine or engine hours, physical condition, options, features, photographs, and other data pertinent to the value of the item. Bidder acknowledges that it is their responsibility to inspect all equipment and to make his own inquires. 22. The purchaser enters the property at their own risk and liability and holds D. Cole Auctioneering LLC harmless for any damage to goods during removal. Purchaser also holds them D. Cole Auctioneering LLC harmless and free of any liability whatsoever for any injury or claims of any kind by any person that may arise during the previews and/or removal of any item or while on the premises.
23. The Seller, or any of the Seller�s agents or employees, or D. Cole Auctioneering LLC or any of its agents or employees, shall not be liable to the Buyer or to Buyer�s agents, employees, contractors, or any other persons or entities acting on their behalf in connection with such removal of the Property, for any loss, damage, personal injury or death, of any kind or character to them arising either from the use of the property of the Seller pursuant to the License granted herein, or caused by any alleged defect or condition in any building, structure, equipment or facility, or any condition on the land of the Seller, any of which are alleged to be the cause of or contributing to the aforementioned loss, damage or personal injury or death. In addition, the Buyer agrees to indemnify and hold harmless Seller and D. Cole Auctioneering LLC and their respective agents, servants and employees of and from any and all liability for any loss, damage, expenses, personal injury or death of any person or persons arising out of, or relating to the removal of the above-described Property. This indemnity and hold harmless agreement is to extend to Seller D. Cole Auctioneering LLC to the fullest extent permitted by law.
